1. Parties and purpose
This agreement is entered into between you and Jonathan Darmouni, 49 rue Saint-Louis, 93250 Villemomble, France ("the Licensor"). It governs your right to use the iOS application Tandem ("the Application"), downloaded via the App Store.
Apple is not a party to this agreement. This agreement supplements the Apple Media Services terms and conditions applicable to your download.
2. Licence
Subject to compliance with this agreement, the Licensor grants you a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to install and use Tandem on the Apple devices that you own or control, in accordance with the App Store usage rules.
The licence is granted for personal or family use. It confers on you no ownership right over the Application.
3. Restrictions
Except where mandatory provisions state otherwise, you may not:
- copy, modify, distribute, sell, rent or sublicense the Application;
- decompile, disassemble or reverse-engineer the Application;
- remove intellectual property notices;
- circumvent security mechanisms or access another household's data without authorisation.
4. Premium features
The Application offers two offerings giving access to the premium features: an auto-renewable monthly subscription and a single lifetime purchase. Their prices and conditions are those displayed by Apple at the time of the order. Payment is charged to the Apple account upon confirmation. The subscription renews automatically each month unless cancelled in the Apple account settings at least 24 hours before the end of the current period. The lifetime purchase is charged once only. Purchases and their restoration are managed by Apple.
Unit of licence. The premium entitlement is attached to the Apple account that made the purchase, and not to a particular household or device. Lifetime access is permanent; monthly access remains valid during each paid subscription period.
Where the buyer is a member of a household, the Application makes that household's premium features accessible to the other members. This extension is not a separate licence: it is neither transferable nor permanent for those members, and ends when the buyer leaves the household or no longer holds any active premium entitlement.
The Licensor may change features for legitimate reasons, in particular of security or compliance, without prejudice to the mandatory rights associated with the lifetime purchase or with subscription periods already paid for.
5. Updates, support and data
The Licensor may offer updates. Apple has no obligation to provide maintenance or support for Tandem. For any question concerning the Application, contact jonathan.darmouni@gmail.com.

6. Warranties and liability
Within the limits permitted by law, the Application is provided "as is" and as available. The organisation and allocation features are indicative.
Nothing in this agreement limits statutory warranties, consumer rights, or liabilities that cannot be excluded or limited under applicable law.
7. Termination
This agreement takes effect upon installation of the Application and remains applicable as long as you use it. You may terminate it by uninstalling the Application. The Licensor may terminate it or suspend synchronisation in the event of a serious breach or a security necessity, within the limits of applicable law.
The provisions relating to intellectual property, to the limitations permitted by law and to data remain applicable after the end of the agreement.
8. Governing law and Apple
This agreement is governed by French law, without prejudice to the more favourable mandatory provisions of your country of habitual residence.
Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce its clauses against you. In the event that the Application does not conform to an applicable warranty, you may notify Apple; to the extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Application.
